Terms of Service

Acceptance

By creating an Atlas account or using any part of the Atlas service, you agree to these Terms of Service ("Terms"). If you don't agree, don't use Atlas.

Atlas is operated by Troy Smith ("we," "us"). Once Snowbird Labs LLC is registered, these Terms will be reassigned to that entity and you'll be notified.

Eligibility

You must be at least 13 years old to use Atlas. If you're between 13 and the age of majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.

Your account

You're responsible for keeping your sign-in credentials secure and for all activity under your account. Notify us promptly at troy@snowbird-labs.com if you suspect unauthorized access.

Acceptable use

You agree not to:

• Use Atlas for any unlawful purpose or in violation of any third-party rights.
• Attempt to gain unauthorized access to other users' data or to Atlas's infrastructure.
• Reverse-engineer, scrape, or attempt to extract source code or data beyond your own.
• Probe, scan, or test the vulnerability of the system in ways that degrade service for others.
• Use Atlas to harass, abuse, or harm another person.
• Use Atlas in ways that violate the terms of any integrated third-party provider (Apple HealthKit, Monarch Money, GHIN, etc.).

Your data

You retain full ownership of any data you upload, connect, or generate while using Atlas. We claim no rights to it. We do not sell, share, or relicense your data. See the Privacy Policy for full handling details.

You grant us a limited license to host, process, and display your data solely for the purpose of operating Atlas for you. That license terminates the moment you delete your account.

Third-party integrations

Atlas connects to third-party services (Apple HealthKit, Monarch Money, GHIN, TrackMan, Rapsodo, BTWB, PADI, Google, Apple, etc.) on your behalf. Your use of those services remains governed by their own terms; Atlas is not responsible for their actions, outages, breaking API changes, or disputes between you and them. We may add, remove, or change supported integrations without notice.

No medical, financial, or professional advice

Atlas displays data you connect — it does not interpret it as professional advice. Specifically:

• Health & fitness data shown in Atlas is not a substitute for medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions. Reference ranges shown for VO2 max, body fat, etc. are educational only.
• Financial data shown in Atlas is informational. It is not investment, tax, or financial advice. Decisions about your finances are yours alone.

Service availability

We work hard to keep Atlas online and accurate, but we provide it "as is" with no warranty of uptime, accuracy, or fitness for any particular purpose. We may modify, suspend, or discontinue any feature without notice.

Pricing & changes

Atlas is currently free to use. We may introduce paid tiers in the future; if we do, current free-tier users will receive at least 30 days' notice before any change affects them, and existing data will remain accessible (or exportable) regardless of pricing.

Termination

You can stop using Atlas at any time. Settings → Account → Delete account immediately removes every row associated with your account.

We may suspend or terminate your account if you violate these Terms or if we're required to by law. We'll give you reasonable notice and a chance to export your data unless the violation is so serious that doing so would harm other users or compromise the service.

Disclaimer of warranties

Atlas is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow these disclaimers; in those, the disclaimers apply to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, neither Atlas nor its operator(s) will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of Atlas. Our total liability for any claim arising under these Terms is limited to the greater of $100 USD or the amount you paid us in the 12 months prior to the claim.

Indemnification

You agree to defend and hold harmless Atlas and its operator(s) from any claim, demand, loss, or damage arising from your misuse of the service or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or to Atlas will be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there.

Changes to these Terms

We'll update these Terms when material things change and bump the "Last updated" date. Substantive changes will be communicated by email to active users at least 14 days before taking effect. Your continued use of Atlas after changes go into effect constitutes acceptance.
